Emergency Purchases and Justification

An emergency purchase is defined as a purchase of goods or services that if not secured immediately, TEES will suffer financial or operational damage. In the case of an emergency, divisions must notify TEES Purchasing immediately. If the emergency occurs after normal business hours, the department shall notify TEES Purchasing on the next business workday.

TEES Purchasing will approve an emergency purchase in accordance with the following provisions:

  • The requisition is marked as an Emergency and a justification is provided in the Internal Notes or Comments Tab in AggieBuy
  • At least three informal bids are encouraged whenever possible on all emergency purchases. An award should be made based on best value, considering the type of emergency.

Justification Requirements

Emergency purchases require a justification documenting the emergency which must be at a minimum address the following:

  • The nature of the emergency purchase (hazard to life, health, safety, welfare, or property or to avoid undue additional cost to the state), and what caused the emergency situation; and
  • The estimated impact or damage either financial or otherwise that will occur by following normal procurement practices (general statements of loss or nominal damage are not acceptable).

The department shall contact TEES Purchasing for advice and assistance in the handling of emergency purchases. TEES Purchasing may not approve an emergency purchase unless the department has complied with the above requirements.
